These Specific Service Use Terms contain the terms under which you use the Diaverum d.CARE Patient App Service that Diaverum AB or any of its affiliates (“Diaverum and Affiliates”) provide.

These Specific Service Use Terms apply in addition to the Diaverum General Service Use Terms, available here. In these d.CARE Patient App Specific Service Use Terms, we refer to the combination of these Specific Service Use Terms and the General Service Use Terms collectively as the “Service Use Terms”. The Service Use Terms describe how you may access and use the Diaverum d.CARE Patient App Service and under what conditions you may do so. When we publish and make the Service Use Terms available in other languages than English, we do that only for the convenience of users. In case of any conflict or inconsistency between an English version and a version in any other language, the English version shall prevail and take precedence.

Please read the Service Use Terms carefully before using the Diaverum d.CARE Patient App Service. By using the Diaverum d.CARE Patient App Service, you agree to be legally bound by the Service Use Terms. If you don’t agree to the Service Use Terms, you may not use the Diaverum d.CARE Patient App Service.

1.         ABOUT THE d.CARE PATIENT APP SERVICE


The d.CARE Patient App Service has been created to enhance communication with patients and increase their commitment to health and involvement in the treatment process. The Service allows patients to view results from their treatments and read about their medications. They will be able to enter data regarding their dialysis treatment, such as medication intake, fluid intake and an evaluation of their quality of life. 2.         PATIENT OR CARER


2.1.
You may use the d.CARE Patient App Service either as a patient receiving care, separately from the use of the d.CARE Patient App, from a Diaverum care facility (“Patient”) or as a carer of and on behalf of a Patient (“Carer”).

2.2. You are only allowed to use the d.CARE Patient App Service as a Carer if the concerned Patient has provided written consent to such use by way of signing the d.CARE Patient App carer and release of data consent form (“CARE Patient App Carer And Release of Data Consent Form”). Hard copies of the d.CARE Patient App Carer And Release of Data Consent Form for signature by Patients are available in Diaverum clinics.

2.3. If you use the d.CARE Patient App Service as a Carer:

  • you must not enter any other data about the Patient than the data listed in the in the CARE Patient App Privacy Notice; and
  • you have an obligation to inform the Patient of any changes to the Service and applicable Service Use Terms and privacy notice.
3.         d.CARE APP SOFTWARE


3.1. In order to use the d.CARE App Service you have to download (from your designated app online store or as otherwise instructed or provided by Diaverum) and install the d.CARE Patient App software (the “
App Software”).

3.2. Your right to download, install and use the App Software is governed by the Diaverum End User Software License Agreement (the “Diaverum EUSLA”), available here.

4.         PRIVACY


4.1. When you use the d.CARE Patient App Service, you will be prompted to submit certain information about yourself, and the Patient if you use the d.CARE Patient App as a Carer, which may contain Personal Data about you, and the Patient as applicable. Examples of such data are health data, contact details and other information.

4.2. In addition, when you use the d.CARE Patient App Service Diaverum will display certain information in the app about you that Diaverum and Affiliates have previously collected, and collect on an ongoing basis, and process as part providing medical treatment and/or other related services to you (separately from the provision of the d.CARE Patient App Service). Examples of such data are treatment results, other current and historical health data and laboratory results.

4.3. Diaverum and/or Affiliates control the above data, collect, and process it for the purposes set out in the privacy notice made available to you when downloading/using the d.CARE Patient App (the “CARE Patient App Privacy Notice”). The d.CARE Patient App Privacy Notice contains elaborate information about, among other things, what Personal Data we collect, what we do with it and our legal ground for doing so.

4.4. As required by law and Diaverum policy, we will ask you to provide consent to our collection and processing of your Personal Data. If you are using the d.CARE App as Carer on behalf of a Patient, such Patient must sign a CARE Patient App Carer And Release of Data Consent Form.

5.         THIRD PARTY SOFTWARE/NOTICES


The App Software contains proprietary third party software (“Third-Party Software”) and/or software licensed under open source licenses (“Open Source Software”). Any notices or additional terms and conditions applicable to such Third-Party Software and Open Source Software (“Third-Party License Terms” and “Open Source License Terms”, respectively) are identified, set out or referenced (with links) directly under a tab in the App Software. By using the Diaverum d.CARE Patient App Service, you agree to be legally bound by such Third-Party License Terms and Open Source License Terms.

6.         OTHER SERVICE SPECIFIC CONDITIONS


6.1. THIS APP REQUIRES AN iOS OR ANDROID DEVICE WITH INTERNET ACCESS. THE APP REQUIRES AN UPDATED OPERATING SYSTEM ON THE DEVICE.

6.2. The App Software has been designed to run on certain devices. If you view or use the App Software on a mobile or handheld device you may experience some delays and functionality limitations. You may experience varying network coverage and speed, depending on your geographic location and telecommunications provider.
